Understanding Tax Forms: W-8, W-9, and 1099 #

Q1: What is a W-8 Form?
A W-8 form is a tax document used by non-U.S. individuals or entities to certify their foreign status and claim exemption from certain U.S. taxes. Common versions include:

  • W-8BEN: For individuals to claim treaty benefits and exemption from withholding tax.
  • W-8BEN-E: For entities to certify foreign status and claim treaty benefits.

Q2: What is a W-9 Form?
A W-9 form is a tax document used by U.S. individuals and entities to provide their Taxpayer Identification Number (TIN) to another person or entity that must report income paid to them.

Q3: What is a 1099 Form?
A 1099 form is issued to U.S. persons by a US entity who has been paid income during the tax year that needs to be reported to the IRS.


Who Needs to Fill Out Which Form? #

Q4: How do I know if I need to fill out a W-8 or W-9 form?

  • W-8: If you are not a U.S. citizen or resident and you are trading or receiving payments through our platform, you will need to fill out a W-8BEN (individual) or W-8BEN-E (entity).
  • W-9: If you are a U.S. citizen, U.S. resident, or a U.S.-registered entity, you must fill out a W-9 form to provide your TIN.

Q5: Will I receive a 1099 form from the company?
Yes, U.S. traders will receive a 1099 form. This form will outline the income earned and will also be submitted to the IRS.


Responsibilities and Filing Taxes #

Q6: Am I responsible for filing my own taxes?
Yes, as a trader, it is your sole responsibility to file your taxes correctly and on time. Our company provides the 1099 form to summarize income earned. However, traders are required to provide a W-8 or W-9 form at the onset to verify their SSN/EIN and allow us to issue the 1099 at the end of the year. It is your duty to abide by the tax laws of your respective country.

Q7: What happens if I do not submit the required W-8 or W-9 tax form?
Failure to provide the correct tax form will result in withholding of payments. For U.S. traders, it may also lead to backup withholding, where the IRS seizes any and all amounts necessary to satisfy the full balance owed to the IRS. This applies to all further 1099 income until the balance is resolved. Ensure your tax forms are submitted to avoid these issues. We strongly advise you to verify your specific obligations with a tax professional or accountant to ensure compliance.


Completing and Submitting Forms #

Q8: How do I complete the W-8BEN or W-9 form?

  • W-8BEN: Include your name, country of residence, and taxpayer identification information. Certify the form and sign it.
  • W-9: Include your name, Social Security Number (SSN) or Employer Identification Number (EIN), and address. Certify the form and sign it.
